Chatbot Terms of Use “Max”

The following provisions govern the use of the AI-powered chatbot “Max” on goCaution's websites.

1. Scope

These terms of use govern the use of the AI-powered chatbot “Max” (hereinafter the “chatbot” or “Max”), which is provided on the websites of goCaution AG, Brünnenstrasse 126, 3018 Bern (hereinafter “goCaution”).

By using the chatbot, you agree to these terms of use. If you do not agree with these terms, please do not use the chatbot.

2. Functionality and purpose

The chatbot “Max” serves as a digital point of contact for general information about rental deposit insurance, goCaution's services and related topics. It is based on artificial intelligence (AI) and is designed to answer frequently asked questions and direct users to the appropriate contact points.

In addition, the chatbot offers a callback function. Through this function, users can create a callback ticket by providing their name, email address and telephone number. This data is used exclusively to process the callback request by goCaution's customer service team and is handled in accordance with the applicable data protection rules. Transmission is encrypted using SSL.

The chatbot does not replace individual legal, insurance or financial advice. The information provided by the chatbot is of a general nature and does not constitute a binding offer or any warranty.

3. No legal or insurance advice

The chatbot's answers are provided for information purposes only. They do not constitute legal advice, insurance advice or any other professional advice. For binding information regarding your specific situation, please contact goCaution's customer service team or a qualified specialist.

goCaution recommends consulting a qualified specialist whenever making legal or financial decisions and not relying exclusively on information provided by the chatbot.

4. Notice regarding artificial intelligence and the knowledge base

The chatbot “Max” is operated entirely on goCaution's own servers in Switzerland. All chat histories and user data remain on these servers and are not transmitted to third-party providers such as OpenAI, Google or other external AI services.

The chatbot accesses a dedicated knowledge base that is maintained independently by goCaution and updated regularly. The answers are based exclusively on the content stored in this knowledge base and not on publicly available internet sources.

Despite careful development, configuration and maintenance of the knowledge base, it cannot be ruled out that the chatbot may provide inaccurate, incomplete or outdated information. AI-generated answers may contain errors or may not fully capture the context of a request. goCaution does not guarantee the accuracy, completeness or timeliness of the information provided by the chatbot.

5. Disclaimer of liability

To the extent permitted by law, goCaution excludes all liability for damages arising from the use of or inability to use the chatbot. This includes, in particular, direct and indirect damages, loss of profit, loss of data or consequential damages of any kind.

Use of the chatbot is at the user's own risk. goCaution is not liable for decisions made on the basis of information provided by the chatbot.

goCaution does not guarantee uninterrupted availability of the chatbot or error-free operation. The chatbot service may be changed, restricted or discontinued at any time without prior notice.

6. Data protection and data processing

Personal data may be processed when using the chatbot. This includes in particular the messages you enter, your IP address and technical data relating to your device and browser.

All data is processed and stored exclusively on servers in Switzerland. No chat data is transferred to third parties or to servers outside Switzerland. Data processing is fully subject to Swiss data protection law. All communication between your browser and the chatbot server is continuously encrypted using SSL/TLS.

The data entered in the chat history is used to process your request and improve the chatbot service. Chat history data may be stored for a limited period to ensure service quality.

Please do not enter sensitive personal data in the chat, especially passwords, credit card numbers, AHV numbers or health data.

7. Usage rules

The chatbot may only be used for its intended purpose. In particular, using the chatbot to disseminate unlawful, offensive, discriminatory or otherwise inappropriate content is prohibited.

It is also prohibited to attempt to manipulate the chatbot through targeted inputs (so-called “prompt injection”), induce it to perform actions unrelated to its intended purpose or circumvent its security mechanisms.

goCaution reserves the right to restrict or block access to the chatbot without prior notice in the event of abusive use.

8. Infrastructure and third-party providers

The chatbot “Max” is hosted on goCaution's own server infrastructure operated in Switzerland. Chat histories, user data and the knowledge base never leave this infrastructure. In particular, no data is transmitted to external AI services such as ChatGPT (OpenAI), Google Gemini, Microsoft Copilot or comparable services.

Where the chatbot provides links to external websites or services, goCaution accepts no responsibility for their content, availability or data protection practices.

9. Intellectual property

The chatbot, including its content, design and underlying technology, is protected by copyright and is the property of goCaution or its licensors. Copying, reproducing, modifying or distributing chatbot content for commercial purposes is prohibited without prior written consent from goCaution.

10. Changes to the terms of use

goCaution reserves the right to amend these terms of use at any time. The current version published on the website shall apply. Continued use of the chatbot after a change shall be deemed acceptance of the updated terms.

11. Applicable law and place of jurisdiction

These terms of use are governed by Swiss law. The exclusive place of jurisdiction is Bern, Switzerland, to the extent permitted by law.
