Cancellation of the rental deposit by tenant and landlord
Just as with a traditional security deposit, the release of the rental deposit requires the agreement of both parties, namely the tenant and the landlord. The rental deposit insurance offers all parties the same protection and conditions as a traditional deposit account and meets the legal requirements pursuant to Art. 257e CO.

Release of the rental deposit by the landlord
If the landlord has no claims after the return of the property, they are obliged to release the rental deposit insurance for the tenant. A written notification by email or post confirming that the insurance is released from its surety obligation is sufficient. In practice, the existing surety certificate is usually filled in, signed and sent to goCaution by email.
Landlords who use our landlord portal can complete this process conveniently and entirely digitally. Any physical surety certificate can be discarded.
Frequently Asked Questions
In Switzerland, the rental deposit for private residential properties is legally limited to a maximum of three months' gross rent (including utilities). A higher demand from the landlord would be invalid. For commercial premises, there is no legal upper limit. However, the amount should be reasonable. Six months' rent is common. The financial stability and creditworthiness of the company are decisive factors.
