Tenants can exercise their right of withdrawal at any time within 14 days. In the event of withdrawal, the tenant undertakes to ensure that the landlord releases ProTect Insurance SA from liability by means of a written declaration to goCaution.
Even after a withdrawal, the landlord as beneficiary may continue to assert claims in good faith under the rental deposit surety bond. In this case, the tenant is obliged to pay the premium, as the nullity of the contract cannot be invoked against the landlord, as provided for in Article 2a, point 5 of the Insurance Contract Act (VVG).
It may also happen that a rental deposit surety bond does not come into effect or must be cancelled because the landlord or property management does not accept it. In this case, we will refund the premium paid in full. A written declaration from the landlord expressly waiving the surety bond is required for this.
