What happens in the event of a claim?

If the landlord asserts legitimate claims from the tenancy after the property handover (e.g. for damage or outstanding rent) that are to be offset against the rental deposit, they must report the claim. To do so, they submit the surety certificate signed by both parties, the final statement and a copy of the tenancy agreement to goCaution.

In the event of disputes, the landlord can enforce payment of the rental deposit by presenting a legally binding payment order or a court judgement.

After review, the claim amount (up to the agreed deposit sum) is paid to the landlord on behalf of ProTect Insurance SA.

An amount paid to the landlord must subsequently be reimbursed by the tenant. The rental deposit insurance is an indemnity insurance, not a traditional liability policy. If legitimate landlord claims must be paid by the insurer, you as the tenant must subsequently reimburse the full amount.
