The tenant refuses – what to do?

If the parties cannot agree on the outstanding amount and the tenant refuses to acknowledge the claims, the same statutory provisions apply as with a traditional rent deposit. The landlord must pursue the matter through legal channels:

  • Initiate debt enforcement proceedings and present a legally valid payment order (without objection from the tenant)
  • In the event of an objection: have it set aside and present a legally binding court judgement
  • Deadline: 12 months after the end of the tenancy (Art. 257e OR)
